Natural Justice
Within the GAAPP Alliance and for general use.
Introduction
The Natural Justice method you will see here is developed for internal use by The GAAPP Alliance. This Alliance is proposal-only at this time. Our immediate attention is to demonstrate its sister trade site, EdensBay.earth in Beta form with 250 vendors, prior to advancing the full offering as proof of concept for member investment. The Alliance is The Great Alliance of Awakened Private People, GAAPP, and of course, simply the Alliance. It is generated in a bilateral venture offering of trade (EdensBay.earth) and self governance (Alliance.land). To belong, members agree to use Natural Justice, however, it can stand anywhere a large group of people employ it. Additionally, we may one day use it in place of standards of procedure to address the lawless procedures of corporatism, and the courts that are captured for its furtherance.
Where is Natural Justice Practiced?
An Alliance Membership contains our mutual agreement, pact and personal contractual obligation to behave in honor, using Natural Justice to remedy and repair peace between us for all civil matters. While it could be used for criminal matters, that will come after a period of use for civil matters.
What is Natural Justice?
Natural Justice is the form of Justice that most closely follows God’s Law, which is the Golden Rule: Do Unto Other As You Would Have Them Do Unto You, and to Do No Thing to Another That You would Not wish done to you.Harm no one, absent protecting yourself and loved ones.It is the Ten Commandments, which appear in religions all over the world with the same directives. It is the basis of our Constitutional Bill of Rights.
Our rights to Life, Bodily Autonomy, Liberty, Travel, Speech, Religion, Freedom from Search and Seizure, the right to reform our mutual governance for a more perfect union, to name a few unalienable rights, are Naturally endowed by virtue of our birth.
For the Alliance, our absolute right to privately contract, for all things that are not ‘evil’, is consequentially important.
Justice is not only delivered by Statute
In Natural Law, we do not compare our behavior to statutes, rules and regulations passed by lawmakers. We compare them to the Golden Rule, and if someone finds them wanting, they make an accusation.
Steps to Natural Justice
If a person has an accusation to make on another, they make it to a first circle mediator. The first circle is just one person, and it is the first of four circles to handle discord. This person is, for the starting of the Alliance, one of the Chapter leaders. The Justice Leader is contacted, and your accusation is recorded, and the Justice leader informs the accused. The two (more parties) are labelled ‘parties to an accusation’, rather than the usual defendant, perpetrator or victim.
The First circle mediator looks for a remedy that will restore peace, and seeks agreement from both parties to abide by it. It's important to bring even small issues to peace early.
the remedy does not sustain peace, the matter moves to the 2nd circle of mediation
The 2nd circle of mediation has 6 mediators, like a petite jury, only no judge is needed, nor lawyers. One of these is the mediator from the 1st circle, who bringd with them the recordings/ evidence from the failed 1st circle mediation effort. One Facilitator is chosen. The parties to the accusation come before the 6 mediators and the mediators ask questions, and delve into the issue and after pondering together offer a 2nd remedy, through the facilitator.
The 3rd circle of mediation has 12 mediators, like a jury, without a judge or lawyers. At least one mediator from the 2nd Circle is part of the 3rd, and up to 4 from the 2nd circle, may move to the 3rd circle. p A new Facilitator is chosen. Recordings/ evidence from the failed 1st and 2nd circle are first presented to the 3rd circle for review, and the 3rd circle shall meet with the parties for further inquiry. Any of the circles may invite witnesses to the accusation, and everyone in the Alliance has by virtue of their membership agreement, stated their dedication to truthfulness as a way of life. The 3rd circle delivers a remedy, and the remedy may be for either both, or all of the parties to an accusation. Harm does not have to have occurred for an accusation of dangerous outcome to be made.
If the matter remains in conflict after the remedy offered by virtue of 12 people attending to the discord, the matter of the accusation moves to the final and 4th circle of mediators.
The 4th circle of mediators is 24 people strong, like the circles before them, two of the mediators from the 2nd and 3rd circles are included and the whole body of 24 listens and reviews the recordings and evidence of the prior 3 circles w/ a new Facilitator.
The 4th circle of 24 meditators indicates a serious problem, because it requires the time and attention of so many members. The 3rd and 4th circles are publicly accessible. This allows for the parties to an accusation to avoid public shame by attending to the remedy of the 1st or 2nd circle. However the matter is remedied by the 24 mediators constructing peace from discord, is a remedy that is demanded and implemented of the parties without review, appeal or change. This is the final option. Prior to the 4th circle the parties can rebuke the remedy.
Documentation
The remedy will be drawn up in private for the 1st and 2nd circles of meditation, and stored away from the Members view with recordings and other evidence until the participant to an accusation dies, even if the participant leaves the Alliance which is a remedy in and of itself.The remedies of the 3rd and 4th circle shall be publicly available, as are the evidences.
At inception, the Alliance will only handle nonviolent matters, and refer to matters of violence to existing Statutory authorities outside the Alliance. However, when the Alliance matures substantially, it can adopt Natural Justice for all matters, and include remedies that are individually tailored for criminal behavior.
Result
Freedom and innocence is upheld, and honored. The Alliance need not worry about reams of statutory legalese, or have their behaviors limited or hindered in that manner. However, upon an accusation, the behavior in question must halt until parsed by mediation. Of course, the larger world is subject to corporate law, statutes, licenses, regulations, torts, and other juristictions that do not recognize natural or constitutional rights. The Alliance begets regenerative communities, and establishes an oasis of Natural Law in practice.
